Davison County felony court cases for April 7


Apr. 9—MITCHELL — The following cases were among those heard Tuesday, April 7, 2026, during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:

* Shelly Klapkin, 58, of Mitchell, was sentenced after admitting to a probation violation in December. The court ordered that her previously suspended five-year prison sentence remain suspended and that her two-year probation period restart.

* Christopher Marshalek, 22, of Mitchell, pleaded guilty to a Class 6 felony charge of third-offense DUI. As part of a plea agreement, a Class 1 misdemeanor charge of driving with a revoked license and a Class 2 misdemeanor charge of possessing an open container were dismissed. Marshalek has been accepted into the James Valley Drug and DUI Court program. The court ordered him to serve three years of probation, fined him $600, and revoked his driver’s license for one year, though he was granted a work permit.

* Jeremy Zwetzig, 47, of Mitchell, made his initial appearance on a Class 6 felony charge of grand theft involving an amount between $1,000 and $2,500. Zwetzig said he plans to apply for a court-appointed attorney, and the court continued the case for two weeks. The court also granted a request to modify his bond, changing it to a personal recognizance bond.

* Tyler Phillips, 34, of Mitchell, appeared in court for a review hearing after previously being granted a furlough to attend the Teen Challenge program. The court was initially informed that Phillips had been unsuccessfully terminated from the program, but Phillips and his defense attorney said he had in fact completed it and was held there until his next court date. The court ordered that his previously suspended 10-year prison sentence remain suspended. Phillips will remain in jail until the Department of Corrections determines his next placement, though the court declared his sentence in this case complete.

* Blaise Hofer, 33, of Mitchell, had his previously scheduled April jury trial moved to June. Hofer is facing five Class 4 felony charges of possession of child sexual abuse material.

* Edwin Reyes, 32, of Houston, pleaded guilty to a Class 5 felony charge of possession of THC edibles. Under a plea agreement, several other charges were dismissed, including a Class 5 felony for possession of cocaine; a Class 1 misdemeanor for possession of 2 ounces or less of marijuana; and Class 2 misdemeanors for possession of drug paraphernalia, driving with a suspended license and speeding. Reyes is scheduled to be sentenced in June.

* Steven Clairmont, 18, of Mitchell, failed to appear in court, and the court issued a $2,000 cash bond bench warrant for his arrest. He faces multiple charges, including Class 5 felony counts of possession of THC and distribution or possession with intent to distribute more than 1 ounce but less than 1 pound of marijuana; a Class 6 felony count of possession of more than 2 ounces but less than one-half pound of marijuana; a Class 1 misdemeanor count of contributing to abuse, neglect or delinquency; and Class 2 misdemeanor counts of possession of drug paraphernalia, underage alcohol use, and possession or consumption of tobacco by a person under 21.

* Tanner Stirling, 30, of St. Paul, appeared in court for an extradition hearing. Stirling is wanted in Alabama on theft of property charges. He told the court he has never been to Alabama and requested a hearing before any extradition order is issued. The court set the matter for a hearing in four weeks.

* Isiah Moccasin, 26, of Fort Thompson, failed to appear in court, and the court issued a no-bond arrest warrant. Moccasin had denied a second probation violation in February and was granted a furlough, but the court said he later absconded.

* Jade Abdo, 37, of Sioux Falls, had her case continued to May. Abdo is currently being held at the Human Services Center in Yankton while participating in a restoration-to-competency program. She is facing two Class 6 felony charges: third or subsequent offense simple assault and simple assault against a law enforcement officer.

* Zachary Cwach, 38, of Mitchell, pleaded not guilty to multiple charges, including two Class 5 felony counts of forgery; three Class 6 felony counts of possession of a forged instrument with intent to defraud; and a Class 6 felony count of grand theft involving an amount between $1,000 and $2,500. A jury trial was scheduled for August. Court documents indicate he had checks belonging to three other individuals and also attempted to use checks at Thune’s True Value Hardware that were not his.

* Robert Hemmah, 42, of Mitchell, pleaded guilty to a Class 6 felony charge of failing to register a new address. The court sentenced him to two years in prison, with the entire sentence suspended.

* Christopher Buchholz, 68, of Mitchell, pleaded guilty to a Class 1 misdemeanor charge of domestic abuse simple assault. As part of a plea agreement, a Class 3 felony charge of aggravated assault by strangulation was dismissed. Buchholz was fined $350 and sentenced to 90 days in jail, with the entire sentence suspended.
